Slip and Fall
Slip and fall accidents can happen to anyone and they happen for many reasons. It could be spills at a supermarket, holes, cracks or elevations in cement, untreated ice, steps that are poorly lit or steps with uneven treads or risers, or even poorly lit parking lots. The key to these cases is the length of time that the defect had existed on the walking surface. Walking is an iconic action. We generally take the same steps when we walk, we generally look a certain distance ahead when we walk, and many times we are looking at the surrounding circumstances for our own safety. It is difficult to see every hole or elevation in concrete or tripping hazard in a poorly lit parking lot or a crowded walkway. The party responsible for making a walkway safe is the party that owns the area; or the party that controls the area. That party has a civil duty to make its property safe.
Many people are able to brush themselves off, get up, and walk away. Unfortunately, not everyone walks away unscathed. We have handled many fall accidents involving fractures, chipped teeth, mangled limbs, and permanent scarring.
If you are involved in a slip and fall incident where you are injured, you should take a picture of the defect, save it and call me.
