Wrongful Death

No matter the cause, no case is more traumatic than the loss of a loved one.  The grief and trauma of the family suffering through this loss caused by the negligence or wrongful acts of others are palpable and actionable.

Since the deceased person is unable to pursue compensation for himself or herself the law permits the family of the victim, or the estate, to bring an action against the party one intends to hold responsible.  Damages include compensation for financial as well as emotional suffering due to the loss of a loved one.  Some cases even call for punitive damages against the wrongdoer.

The wrongful death lawsuit may only be filed by a personal representative of the deceased person’s estate.  The deceased may have identified a personal representative in his or her Will and it may be a family member or a professional administrator.
